Business-based residence permit
A business-based residence permit is one of the grounds with the highest financial requirements, yet it gives you maximum independence in choosing counterparties worldwide. Since 2022, we've specialized in supporting IT specialists, many of whom chose this legalization path after moving to Poland. We've prepared more than a hundred business plans for our clients and understand the specifics of various IT fields and positions well. Does your business case qualify?
The review happens on two levels: first, the right to run your chosen form of activity, then the company's own criteria and personal conditions. A weak link at either level means a refusal.
Right to the form of activity
A JDG (sole proprietorship) is available only to foreigners with a specific status: permanent residents, EU residents, full-time students, spouses of Polish citizens, Blue Card holders, UKR status holders, Karta Polaka holders, and a number of others. Holders of a visa or a regular work-based residence card are left with a spółka z o.o. (capital from 5000 zł) — board membership also provides grounds for the card (art. 142 ust. 3).
The company criterion — one of three
Income for the past tax year of at least 12× the average voivodeship salary (around 114 000 zł in Mazowieckie, from ~86 000 zł in other regions), or at least 2 full-time employees for at least a year, or proven potential: investments, contracts, job creation.
Personal conditions
Health insurance, a place of residence in Poland, no outstanding debts to ZUS and US, and the company's financial indicators meeting the established requirements.
The 12× thresholds are updated annually based on GUS data on voivodeship salaries — we track the current values.
JDG or spółka z o.o. — which to choose?
Both forms lead to a card under art. 142, but the starting conditions and tax burden differ significantly. We compare the third option — the incubator — honestly too: it doesn't give a business-based card.

What a business-based residence permit gives you
Legal business and status in one
A card valid for up to 3 years with the right to run your activity. Issued to continue a JDG, it keeps your right to work for yourself for the entire term.
Freedom of contracts
The card's grounds are your activity, not a specific client: you can change clients and contracts without notifications or new procedures.
B2B tax efficiency
Income earned by IT specialists through a JDG is most often taxed at the ryczałt rate of 8,5% or 12%. At high income levels, the difference compared to UoP can be substantial.
Schengen 90/180
With a Karta Pobytu, you can travel freely across Schengen countries for up to 90 days in any 180 — for client meetings and vacations.
A path for your family
After 2 years on consecutive cards, you can apply for family reunification — your spouse will receive a card with full labor-market access.
A path to EU residency
Years spent on a business-based card count in full toward the 5-year tenure required for EU long-term resident status — with a stable income and Polish B1.

From 27 April 2026, applications are accepted only through the MOS system, and the applicant must sign them personally. We prepare the application and go through the filing with you online — from logging in via profil zaufany to receiving confirmation of receipt.

Reasons for refusal of a business-based residence permit and how we help you avoid them
As a rule, a refusal isn't related to income level or doubts about the contract, but to a lack of attention to detail in the documents.
Incorrectly prepared documents
A refusal may not stem from missing documents, but from errors in how they're prepared: wrong dates, missing signatures, imprecise wording, or non-compliance with the office's requirements.

Documents no longer current by the decision date
Documents may be current when the application is filed, but 6–8 months later the situation changes: contracts expire, company details change, or new requirements appear.

Insufficient justification for the business plan
The mere fact of registering a business doesn't guarantee a residence permit. You need to convincingly show that the activity is real, economically justified, and has development prospects.

A template business plan
Errors, generic wording, or template content can create the impression that the business plan is insufficiently thought out or was prepared formally through AI.

Missed voivode requests and procedural deadlines
Correspondence with the office is often conducted electronically. Requests can arrive by email, and missing an established deadline can negatively affect the case review.

Insufficient proof of the company's real activity
The voivode evaluates not just the existence of a registered business, but its actual activity: contracts, income, expenses, clients, and development prospects.

A refusal isn't a final verdict: 14 days for an odwołanie via the voivode to the Urząd do Spraw Cudzoziemców. We review the reasons and strengthen the case for a second attempt.
